Electric car charging point – Mandatory by December 31, 2024!

A surprising number of companies have missed the fact that, according to regulations, non-residential buildings with more than 20 parking spaces are required to install an electric car charging point by December 31, 2024 at the latest .

In this article, I will explain who is subject to the installation obligation. However, please note that the article is not an official decision and does not exempt the owner from liability under Section 7 of the Charging Act, even if the property is not covered by the obligation.

Who is subject to the obligation to install an electric car charging point?

The requirement to install an electric car charging point applies to companies whose buildings use energy to maintain the indoor climate, such as heating or cooling, and which have more than 20 parking spaces inside the building or on the same property.

Exceptions include:

  • Residential buildings where more than half of the floor area is for residential use.
  • Buildings without energy to maintain the indoor climate (e.g. warehouses).
  • Defense Administration buildings .
  • Micro-enterprises with fewer than 10 employees and an annual turnover of less than 2 million euros.
  • However, the exemption for micro-enterprises only applies when both the owner and the user of the building are micro-enterprises. For example, a property owned by a micro-enterprise but used by someone other than a micro-enterprise is still subject to the obligation.
  • Properties owned by micro-enterprises where more than one micro-enterprise is the user will be reviewed on a case-by-case basis.

Charging point requirements

  • must be intended for charging an electric car
  • charging point power over 3.7kW
  • equipped with Type2 or CCS connector, depending on the charging point’s characteristics
  • A public charging point in accordance with the Act on the Distribution of Alternative Fuels for Use in Traffic can also be used as a charging point.

Communication about the obligation has been surprisingly minimal. I dare say that many companies are not even aware of the existence of the obligation, and that they will be in a hurry to fulfill it. Traficom announces that it will start monitoring the obligation as soon as January.
